Welcome to Chat Pen. These Terms & Conditions govern your use of the Chat Pen mobile application and website. By signing in and continuing to use our services, you agree to be bound by these terms. If you do not agree, please do not use the app.

1. Account & Sign-In

  • You must create an account to use Chat Pen. You can sign in using Sign in with Apple or Sign in with Google.
  • You are responsible for keeping your account credentials secure. Do not share your account with others.
  • You must provide accurate information when creating your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

2. Subscriptions & In-App Purchases

a) Subscription Plans

  • Chat Pen offers a Pro subscription that unlocks all features and AI models.
  • Available plans: Monthly ($9.99/month) and Yearly ($24.99/year, billed annually).
  • A 3-day free trial is available for new subscribers. Cancel before the trial ends and you will not be charged.

b) Payment Processing

  • All payments are processed by Applethrough the App Store's in-app purchase system.
  • We do not have access to your full payment information. Apple handles all billing, charging, and transaction processing.
  • Your purchase is subject to Apple's Media Services Terms and Conditions.

c) Cross-Platform Access

  • Your Pro subscription works across all your devices — iPhone, iPad, and web — under the same account.
  • Sign in with the same account on any device to access your Pro features. Your subscription status syncs automatically.

d) Cancellation & Refunds

  • You can cancel your subscription at any time through your Apple ID settings: Settings → Apple ID → Subscriptions.
  • After cancellation, you will retain access until the end of your current billing period.
  • Refund requests should be directed to Apple Support, as all billing is handled by Apple. We do not have the ability to issue refunds for App Store purchases.

e) Price Changes

We may change subscription prices in the future. If we do, Apple will notify you of the price change. Your subscription will automatically renew at the new price unless you cancel before the renewal date.

3. AI Model Usage

  • Chat Pen provides access to multiple AI models (GPT, Claude, Gemini, DeepSeek, Grok, Qwen, Kimi, MiniMax, and others).
  • When you send a message, your text prompt is transmitted directly to the selected AI model provider's API. The provider processes your request and returns a response.
  • When you upload imagesfor vision understanding, they are sent to the AI model provider's API for analysis.
  • When you upload PDF filesfor document understanding, they are sent to the AI model provider's API for analysis.
  • When you use the speech-to-textfeature, your voice is transcribed and the resulting text is sent to the AI model provider's API.
  • Each AI model provider operates under their own terms of service and privacy policy. By using a model, you also agree to that provider's terms.
  • AI-generated responses may not always be accurate. You are responsible for evaluating and verifying any information provided by AI models. Do not rely solely on AI responses for critical decisions.
  • We do not control the output of AI models and are not responsible for their content.

4. Data Storage

  • Mobile app (iOS): All chat responses are stored locally on your device. They are never uploaded to our servers. If you delete the app, your chat data is removed from your device.
  • Web app: All chat data is stored securely in our cloud database. Only you can access your data through your authenticated account.
  • You may delete individual chats at any time from within the app.

5. Acceptable Use

You agree not to use Chat Pen to:

  • Violate any applicable laws or regulations.
  • Generate content that is illegal, harmful, threatening, abusive, harassing, or otherwise objectionable.
  • Attempt to reverse-engineer, decompile, or disrupt the app or its services.
  • Impersonate any person or entity.
  • Use the service in any way that could damage, disable, or impair the app or its servers.
  • Share your account with others.

6. Intellectual Property

  • The Chat Pen app, including its design, logo, and software, is the property of Chat Pen and is protected by intellectual property laws.
  • AI-generated content is provided for your personal use. You are responsible for how you use and distribute such content.
  • You retain ownership of the prompts you submit to the AI models.

7. Limitation of Liability

  • Chat Pen is provided "as is" without warranties of any kind, either express or implied.
  • We do not guarantee that the app will be error-free, uninterrupted, or meet your specific requirements.
  • We are not responsible for the accuracy, reliability, or content of AI-generated responses.
  • In no event shall Chat Pen be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.

8. Indemnification

You agree to indemnify and hold harmless Chat Pen from any claims, damages, or expenses arising from your use of the app or your violation of these terms.

9. Termination

We may terminate or suspend your account at our sole discretion if you violate these terms. Upon termination, your right to use the app will immediately cease. Provisions that by their nature should survive termination will remain in effect.

10. Changes to These Terms

We may update these Terms & Conditions from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of Chat Pen after any changes constitutes acceptance of the updated terms.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
